PartnerWellers helps you explore alternative dispute resolution (ADR), ways to resolve a dispute outside court, with legal support for mediation, arbitration and adjudication. These approaches can be used before or alongside litigation, giving you options for reaching an agreement or obtaining a decision without taking every issue through court proceedings.
make an enquiryADR is becoming increasingly popular as a resolution outside of court as it incurs less time and costs. Further, the courts encourage the use of ADR and can even penalise parties on costs if ADR has not been considered in certain circumstances.
Wellers’ dispute resolution solicitors are highly experienced in litigation but are equally qualified to resolve matters through ADR. ADR methods considered and used by our litigation team include:
The right approach depends partly on how much control you want over the outcome. Mediation may suit you if you want to negotiate settlement terms yourself; arbitration may suit you if you want an independent person to decide the dispute.
Your solicitor can help you weigh that choice against what you need from resolving the dispute. You may want scope to compromise, or need a decision where agreement seems unlikely. Wellers’ litigation experience supports advice on how your chosen approach can fit with any court proceedings already under way.
ADR may reduce the time and money spent resolving a dispute, though an unsuccessful attempt can add to the overall cost if further proceedings are needed. Considering the likely expense alongside the outcome you need helps you weigh up whether an approach offers value for your circumstances.

Could not recommend this Law firm enough. They dealt with a very complex case for us and went above and beyond to provide advice, support, and time to getting it through. Thank you!
The service we received was outstanding. All our queries were dealt with promptly and efficiently. We were advised and updated throughout the process and the communication was fantastic. I can thoroughly recommend the service they provide.
Yes. Starting court proceedings does not rule out ADR. For example, you can still use mediation to explore a settlement while your case is under way.
A mediator supports negotiations, but you and the other party choose whether to settle. An arbitrator considers the evidence and decides the dispute through a binding award.
An arbitration award binds the parties. A mediation settlement can be formalised in a settlement agreement, but attending mediation alone does not mean you have a binding settlement.
ADR can offer savings, but it will not always cost less than court proceedings. If the dispute remains unresolved, its costs may sit alongside those of further legal action.
Discussing ADR with your solicitor can help you understand the possible cost consequences. Courts in England and Wales may take a failure to consider it into account when deciding costs.
