Claim for a child

One particular case will always remain vivid in Helen’s memory as a particularly rewarding conclusion to a very distressing claim. She was the second lawyer instructed by a client who had been advised by another firm that she did not have a case. However, when she read the previous solicitors file it was evident that no medical records had been obtained, no expert evidence had been obtained. A short advice had been supplied by a non specialist barrister who advised that there was no evidence of negligence. Of course, he had been asked for an advice but no evidence had actually been obtained.

When Helen obtained the medical records and an independent medical expert’s report, everything fell into place, negligence was suspected and so that she could assist the parents of a seven year old girl who had suffered a brain injury as a result of a negligently administered anaesthetic.

Claim for spouse following untimely death of Husband

Madeleine Terry contacted Helen following the death of her husband in 2007. Alan, aged 55, was previously a fit and healthy man but whilst on holiday in 2006 he started to feel generally unwell. Alan’s GP referred him urgently to hospital as he suspected advanced liver disease (unknown origin). The expert in this case felt the diagnosis for Alan would have been obvious at the time of his first hospital appointment.

However, Alan’s tests were not escalated and no treatment was provided. By the time Alan displayed serious symptoms treatment was too late. Alan suffered total organ failure as once he had deteriorated beyond a certain point even a liver transplant was not an option.

It was believed timely treatment would have been wholly successful. The medical expert confirmed Alan’s life was cut short as a result of the NHS negligent delay in providing treatment which would have saved his life.  The Claim was successfully settled under the terms of the Fatal Accidents Act.

Bladder Injury Caused during Hysterectomy

Hundreds of thousands of women have hysterectomy each year and most are largely successful. However, the surgery is complicated. Helen’s client in this case suffered damaged to her bladder when the surgeon “nicked” the bladder during surgery. The injury was noticed and the surgeon thought the repair carried out immediately was successful.

However, Helen’s client started to suffer abdominal pain but despite morphine she became increasingly distressed. It was later discovered that she was suffering sepsis and respiratory distress as a result of a urine leak inside the body. An urgent bladder repair was successfully carried out by an appropriate expert doctor but our client will now always suffer serious bladder weakness as a result of which she is now withdrawn, has little confidence and avoids going out whereas she was previously fit and healthy.
