Many people who are married to British Citizens may wish to come to the UK in order to live with their spouse and gain British Citizenship.
The Home Office are really trying to clamp down on 'phony marriages' and so they are currently interviewing random applicants with a view to obtaining further information into your married life so as to assure themselves that there is a genuine relationship in existence and a genuine intention to live together permanently as husband a wife.
You may therefore be called to the Home Office to attend an interview which Wellers can prepare you for and, if you wish, attend with you. Wellers cannot however guarantee any questions that are asked of you at the interview and obviously cannot guarantee what decision will be made.
In order to submit an application to the Home Office for consideration, we will require evidence of the following:
- That you are married
- That you have met each other and intend to live together as husband and wife
- That you have the funds to house and maintain yourself and your spouse whilst in the UK
- That the relationship is subsisting and continuing
- That your spouse is a British citizen with the right to reside in the UK
In the event that you were in the UK on a visa at the time of meeting and marrying your partner, we shall also require evidence that you had permission to be in the UK at the time of your marriage as well as permission from the Home Office to marry at the time that you did.
There is a Home Office fee of £395 payable when the application for the marriage visa is posted to the Home Office for consideration or a fee of £595 if you wish for your application to be submitted in person.
Whilst the timing of the decision to be made by the Home Office is not within our control and can often take months, we will monitor the application by being in regular contact with the Home Office and reporting progress to you throughout that period until a decision is made on your application.
