Accident at Gymkhana

The injured client had been to see her sister participate in a gymkhana. The gymkhana had several different classes being held at the same time. The arenas were divided by tape only and the spectators, riders and horses had no defined areas. Our client was injured when a horse became spooked and kicked out at the crowd. The proximity of the crowd at the edge of the arena meant that a horse could easily be spooked. It was agreed that the organisers had not fulfilled their duty to keep spectators safe and had caused or permitted spectators to be too close to the competing horses.
