Stages of the Divorce Process

 

Reasons for granting a divorce
 
There are 5 reasons for a divorce to be granted:
 
·         Adultery by the respondent (anybody else named in the divorce will be called a co-respondent)
·         Desertion by the respondent for 2 years or more Unreasonable behaviour
·         Separation for 2 years (both parties to agree)
·         Separation for 5 years  
Applying for a divorce
 
·         either you, your husband or wife makes the application for a divorce – this is called a Petition - the person who makes the application is called the Petitioner
·          your husband/wife i.e. the other party is called the Respondent
 
Serving documents on the Respondent
 
·         The following documents are then served on the Respondent 
·         The divorce petition
·         Statement of arrangements for any children of the family
·         Notice of proceeding
·         Acknowledgement of Service
